## 1. Definitions

**"Copyright Holder"** means the individual or entity named in the copyright notice above.

**"Licensee"** means any individual or entity exercising rights under this License.

**"Licensed Work"** means any content or asset identified as being licensed under ETO-FC, provided by the Copyright Holder.

**"Work"** means any product or content created by the Licensee that incorporates the Licensed Work.

**"Attribution"** means clear identification of the Copyright Holder in a manner reasonably calculated to inform a user of the source.

**"License Fee"** means the fee for non-compliant use under Section 4. The License Fee amount is determined by the Copyright Holder and published at the License URL.

## 2. Grant of License

Subject to the terms and conditions of this License, the Copyright Holder hereby grants the Licensee a worldwide, royalty-free, non-exclusive, non-transferable license to:

- reproduce the Licensed Work;
- distribute or publicly perform the Licensed Work, including by streaming or broadcast;
- create derivative works based on the Licensed Work (including by editing, remixing, or otherwise modifying);
- use the Licensed Work in commercial projects.

## 3. Conditions

### 3.1 Free Use

The Licensee may use the Licensed Work free of monetary charge **only if** clear and reasonable Attribution is provided with each use. The Attribution must appear in the credits, description, or an equivalent location reasonably calculated to inform a user of the source.

### 3.2 Consideration

The Licensee's obligation to provide Attribution is a material term of this License. Free use is granted solely in consideration of the Licensee's compliance with Section 3.1.

## 4. License Fee for Non-Compliant Use

If the Licensee uses the Licensed Work without providing the Attribution required by Section 3.1, such use is not free and the Licensee shall pay the Copyright Holder a License Fee. The License Fee amount per Licensed Work per Work is determined by the Copyright Holder and published at the License URL.

The License Fee is a contractual payment obligation for the rights granted, not a penalty. It accrues immediately upon non-compliant use and is due within thirty (30) days of the Copyright Holder's demand.

Payment of the License Fee satisfies the Attribution requirement for the specific use for which it is paid. No retroactive attribution is required after payment.

## 5. Commercial Use

Commercial use is permitted under this License subject to Section 3 (free with Attribution) or Section 4 (License Fee).

## 6. Modifications

The Licensee may create derivative works from the Licensed Work. Modified versions remain subject to this License. The Licensee may not redistribute the Licensed Work or its derivatives as standalone files (e.g., as an asset pack) and may not assert ownership of the original Licensed Work.

## 7. Disclaimer of Warranty

THE LICENSED WORK IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COPYRIGHT HOLDER BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM OR IN CONNECTION WITH THE LICENSED WORK OR ITS USE.

## 8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COPYRIGHT HOLDER'S TOTAL LIABILITY UNDER THIS LICENSE SHALL NOT EXCEED THE TOTAL LICENSE FEES PAID BY THE LICENSEE UNDER SECTION 4.

## 9. Termination

This License automatically terminates upon the Licensee's breach of any term. Upon termination, the Licensee must cease all use of the Licensed Work and destroy all copies. The Copyright Holder may, at its sole discretion, grant a thirty-day cure period. Sections 4, 7, and 8 survive termination.

If any provision of this License is held invalid or unenforceable, the remainder shall continue in full force and effect.
